Article L2281-7 of the French Labour Code

If the employer fails to take the initiative within a period of one year in the event of an agreement, or three years in the absence of an agreement, negotiations must begin at the request of a representative trade union organisation within fifteen days of the request being made.

This request is forwarded to the other representative trade union organisations by the employer within eight days.

The starting point for the one-year or three-year period is the date of commencement of the previous negotiations.

A défaut d’initiative de l’employeur dans le délai d’un an en cas d’accord, ou de trois ans en l’absence d’accord, la négociation s’engage obligatoirement à la demande d’une organisation syndicale représentative dans les quinze jours suivant la présentation de cette demande.

Cette demande est transmise aux autres organisations syndicales représentatives par l’employeur dans les huit jours.

Le point de départ du délai d’un an ou de trois ans est la date d’ouverture de la négociation précédente.
