Article L2411-1 of the French Public procurement code

Project owners are principally responsible for the project. They may not delegate this function of general interest, defined in Title II, subject to the provisions of this book relating to the mandate and transfer of project ownership, the provisions of Book II relating to partnership contracts, article L. 121-5 of the Highway Code and articles L. 115-2 and L. 115-3 of the same code.

The following purchasers are contracting authorities:

1° The State and its public establishments;

2° Local authorities, their public establishments, the public housing offices mentioned in article L. 411-2 of the French Construction and Housing Code for rental housing assisted by the State and built by these bodies and their groupings;

3° The private bodies mentioned in article L. 124-4 of the French Social Security Code, as well as their unions or federations;

4° Private low-cost housing bodies, as referred to in article L. 411-2 of the French Construction and Housing Code, and semi-public companies, for State-subsidised rental housing built by these bodies and companies.

Article L2411-1

Les maîtres d’ouvrage sont les responsables principaux de l’ouvrage. Ils ne peuvent déléguer cette fonction d’intérêt général, définie au titre II, sous réserve des dispositions du présent livre relatives au mandat et au transfert de maîtrise d’ouvrage, des dispositions du livre II relatives aux marchés de partenariat, de l’article L. 121-5 du code de la voirie routière et des articles L. 115-2 et L. 115-3 du même code.

Sont maîtres d’ouvrage les acheteurs suivants :

1° L’Etat et ses établissements publics ;

2° Les collectivités territoriales, leurs établissements publics, les offices publics de l’habitat mentionnés à l’article L. 411-2 du code de la construction et de l’habitation pour les logements à usage locatif aidés par l’Etat et réalisés par ces organismes et leurs groupements ;

3° Les organismes privés mentionnés à l’article L. 124-4 du code de la sécurité sociale, ainsi que leurs unions ou fédérations ;

4° Les organismes privés d’habitations à loyer modéré, mentionnés à l’article L. 411-2 du code de la construction et de l’habitation, ainsi que les sociétés d’économie mixte, pour les logements à usage locatif aidés par l’Etat et réalisés par ces organismes et sociétés.
