Article L2512-4 of the French Public procurement code

The rules laid down in Title II shall apply to public service contracts concluded with a purchaser subject to this Part where the latter enjoys an exclusive right by virtue of a provision adopted by law, provided that this provision is compatible with the Treaty on the Functioning of the European Union.

Sont soumis aux règles définies au titre II les marchés publics de services conclus avec un acheteur soumis à la présente partie lorsque celui-ci bénéficie, en vertu d’une disposition légalement prise, d’un droit exclusif, à condition que cette disposition soit compatible avec le Traité sur le fonctionnement de l’Union européenne.
