Carrying out any of the operations mentioned in 1°, 2° and 3° of Article L. 310-1 on French territory without complying with the provisions of Articles L. 310-2 and L. 310-6 or with the provisions of I of Article L. 310-2-3 is punishable by three years’ imprisonment and a fine of 75,000 euros.
Carrying out one of the operations mentioned in I of article L. 310-1-1 on the territory of the French Republic without complying with the provisions of III of article L. 310-1-1 is punishable by the same penalties.
Where a natural person has committed one of the offences referred to in the previous paragraph, dissemination of the decision, under the conditions laid down in article 131-35 of the Criminal Code, may be ordered as an additional penalty.
Legal entities declared criminally liable, under the conditions provided for by article 121-2 of the Criminal Code, for the offences defined in this article shall incur, in addition to a fine in accordance with the procedures provided for by article 131-38 of the Criminal Code, the penalty provided for by 4° of article 131-39 of the same code.
Persons who have taken out a policy in good faith with an undertaking whose closure has been ordered by the court enjoy the same privileges and guarantees as those reserved by this Code for policyholders and beneficiaries in the event of the liquidation of an insurance undertaking.
