Article L310-7 of the French Insurance Code

A decree of the Conseil d’Etat determines the conditions of incorporation of companies subject to State control by virtue of article L. 310-1 and 1° of III of article L. 310-1-1 and of supplementary professional retirement funds. It specifies the conditions under which the provisions of articles L. 210-1 et seq. of the Commercial Code and the laws governing public limited companies are applicable to these companies and funds. Special provisions take account of the non-commercial nature of mutual insurance companies.

The same decree sets out the obligations to which French and foreign companies are subject, the guarantees they must provide, the reserves and technical provisions they must establish, the general rules governing their operation, their internal control and the exercise of State control.

Article L310-7

Un décret en Conseil d’Etat détermine les conditions de constitution des entreprises soumises au contrôle de l’Etat en vertu de l’article L. 310-1 et du 1° du III de l’article L. 310-1-1 et des fonds de retraite professionnelle supplémentaire. Il précise les conditions dans lesquelles sont applicables à ces entreprises et fonds les dispositions des articles L. 210-1 et suivants du code de commerce et des lois régissant les sociétés anonymes. Des dispositions particulières tiennent compte du caractère non commercial des sociétés d’assurance mutuelles.

Le même décret fixe les obligations auxquelles les entreprises françaises et étrangères sont astreintes, les garanties qu’elles doivent présenter, les réserves et provisions techniques qu’elles doivent constituer, les règles générales de leur fonctionnement, de leur contrôle interne et de l’exercice du contrôle de l’Etat.
