I.-Provided that the essential obligations of the contract continue to be met, the implementation of a crisis prevention or management measure referred to in Articles L. 311-12, L. 311-14 or L. 311-30 of this Code or Articles L. 612-33 and L. 612-34 of the Monetary and Financial Code, which is taken with regard to a person referred to in Article L. 311-1 party to this contract, or the occurrence of any event directly linked to the application of such a measure, does not allow :
1° Exercise the rights of cancellation, suspension, modification and compensation attached to this contract;
2° Become the owner of an item of the assets of this person or of any entity belonging to the same group that has entered into a contract with this person that includes cross-default provisions, to use or dispose of it or to enforce a security interest;
3° Prejudice the contractual rights of this person, or of any entity belonging to the same group that has entered into a contract with this person that includes cross-default provisions.
II – The provisions of I also apply where the contract referred to in the first paragraph is entered into by :
1° An affiliated undertaking of the person concerned whose obligations are guaranteed by an entity of the group to which this entity belongs;
2° An entity belonging to the same group as the person concerned, provided that this contract includes cross-default provisions.
III – The provisions of this article are overriding legislation within the meaning of Article 9 of Regulation (EC) No 593/2008 of the European Parliament and of the Council of 17 June 2008. However, the provisions of I shall not affect the rights in rem, within the meaning of the applicable law, provided for in a contract referred to in I, of a creditor or a third party in respect of tangible or intangible, movable or immovable assets belonging to that person and which are located, at the time of implementation of the resolution procedure, in the territory of another Member State of the European Union or party to the European Economic Area.
