Article L311-45 of the French Insurance Code

The decision of the collège de résolution approving the trust agreement referred to in I of Article L. 311-42 shall be published in the Journal officiel. By way of derogation from article 2018-2 of the French Civil Code, this publication shall render the assignment of the debt resulting from the creation of the trust enforceable against any debtor.

This decision releases, for the duration of the trust contract or until it is terminated pursuant to article L. 311-47, the person subject to the resolution procedure from all commitments to policyholders, participating members, employer subscribers, legal entities subscribing to the transferred contracts, members and beneficiaries of benefits relating to the transferred contracts.

La décision du collège de résolution approuvant le contrat de fiducie mentionné au I de l’article L. 311-42 est publiée au Journal officiel. Par dérogation à l’article 2018-2 du code civil, cette publication rend opposable à tout débiteur la cession de sa créance résultant de la constitution de la fiducie.


Cette décision libère, pour la durée du contrat de fiducie ou jusqu’à ce que ce dernier s’achève en application de l’article L. 311-47, la personne soumise à la procédure de résolution de tout engagement envers les assurés, membres participants, souscripteurs employeurs, personnes morales souscriptrices des contrats transférés, adhérents et bénéficiaires de prestations relatives aux contrats transférés.
