The types of media, the rates of remuneration and the methods of payment thereof shall be determined by a commission chaired by a representative of the State and composed, in addition, as to half, of persons appointed by the organisations representing the beneficiaries of the right to remuneration, as to one quarter, of persons appointed by the organisations representing the manufacturers or importers of the media mentioned in the first paragraph of article L. 311-4 and, for a quarter, persons designated by organisations representing consumers. Three representatives of the ministers responsible for culture, industry and consumer affairs participate in the work of the committee in an advisory capacity. Within two months of their appointment, the Chairman and members of the Commission will send the Chairman of the Haute Autorité pour la transparence de la vie publique a declaration of interests as provided for in III of the Article 4 of the loi n° 2013-907 du 11 octobre 2013 relative à la transparence de la vie publique.
The commission’s rules of procedure and amendments thereto are published in the Journal officiel.
The minutes of the commission’s meetings are made public, in accordance with procedures laid down by decree. The commission publishes an annual report, transmitted to Parliament.
The commission’s deliberations are binding if, within one month, its chairman has not requested a second deliberation.
The commission’s decisions are published in the Official Journal of the French Republic.
