Article L3112-3 of the French Public procurement code

A grouping of concession-granting authorities may be formed with concession-granting authorities from other Member States of the European Union, provided that this choice has not been made for the purpose of evading the application of national provisions affecting public policy.
Notwithstanding the provisions of article L. 3112-2, and subject to the stipulations of international agreements or administrative arrangements between the Member States to which they belong, the members of the grouping agree on the division of responsibilities and on the law applicable to the concession contract, chosen from among the laws of the Member States to which they belong.

Article L3112-3

Un groupement d’autorités concédantes peut être constitué avec des autorités concédantes d’autres Etats membres de l’Union européenne, à condition que ce choix n’ait pas été fait dans le but de se soustraire à l’application de dispositions nationales qui intéressent l’ordre public.
Nonobstant les dispositions de l’article L. 3112-2, et sous réserve des stipulations d’accords internationaux ou d’arrangements administratifs, entre les Etats membres dont ils relèvent, les membres du groupement s’accordent sur la répartition des responsabilités ainsi que sur le droit applicable au contrat de concession, choisi parmi les droits des Etats membres dont ils relèvent.
