Article L312-12 of the French Sports Code

Authorisation to open to the public temporary facilities set up in a sports arena subject to the provisions of article L. 312-5 is granted by the mayor under the conditions laid down by the provisions of the Construction and Housing Code and by the approval order.

Once the work has been completed, the relevant safety commission must issue an opinion on these temporary facilities following a site visit. This opinion is notified to the authority with the power to authorise the opening to the public. The committee will issue an unfavourable opinion if all or some of the conditions for fitting out these facilities laid down in the approval provided for in article L. 312-5 are not complied with.

Article L312-12

L’autorisation d’ouverture au public des installations provisoires aménagées dans une enceinte sportive soumise aux dispositions de l’article L. 312-5 est accordée par le maire dans les conditions prévues par les dispositions du code de la construction et de l’habitation et par l’arrêté d’homologation.

Ces installations provisoires doivent faire l’objet, après achèvement des travaux, d’un avis délivré, à l’issue d’une visite sur le site, par la commission de sécurité compétente. Cet avis est notifié à l’autorité titulaire du pouvoir d’autoriser l’ouverture au public. La commission émet un avis défavorable si tout ou partie des conditions d’aménagement de ces installations fixées par l’homologation prévue à l’article L. 312-5 ne sont pas respectées.
