The concession contract is awarded to the bidder who has submitted the best offer with regard to the overall economic advantage for the conceding authority on the basis of several objective, precise criteria linked to the subject of the concession contract or its performance conditions. Where the management of a public service is awarded under a concession, the awarding authority will also base its decision on the quality of the service provided to users.
The award criteria will not give the awarding authority unlimited freedom of choice and will guarantee effective competition. They shall be made public in accordance with the conditions laid down by decree in the Conseil d’Etat.
The procedures for applying this article shall be laid down by regulation.

Le contrat de concession est attribué au soumissionnaire qui a présenté la meilleure offre au regard de l’avantage économique global pour l’autorité concédante sur la base de plusieurs critères objectifs, précis et liés à l’objet du contrat de concession ou à ses conditions d’exécution. Lorsque la gestion d’un service public est concédée, l’autorité concédante se fonde également sur la qualité du service rendu aux usagers.
Les critères d’attribution n’ont pas pour effet de conférer une liberté de choix illimitée à l’autorité concédante et garantissent une concurrence effective. Ils sont rendus publics dans des conditions prévues par décret en Conseil d’Etat.
Les modalités d’application du présent article sont prévues par voie réglementaire.
