Article L3126-3 of the French Public procurement code

Without prejudice to the provisions of Regulation (EC) No 1370/2007 of the European Parliament and of the Council of 23 October 2007 on public passenger transport services by rail and by road, as amended, concession contracts, with the exception of those relating to passenger transport by rail mentioned in Chapter I of Title II of Book I of Part Two of the Transport Code covered by Article 5(3) thereof, are subject to the provisions of Titles I and II, with the exception of Articles L. 3113-1 to L. 3113-3, the second paragraph of Article L. 3114-1 and Articles L. 3114-2, L. 3114-3 and L. 3114-7 to L. 3114-10.

Article L3126-3

Sans préjudice des dispositions du règlement (CE) n° 1370/2007 du Parlement européen et du Conseil du 23 octobre 2007 relatif aux services publics de transport de voyageurs par chemin de fer et par route modifié, les contrats de concession, à l’exception de ceux relatifs au transport de voyageurs par chemin de fer mentionnés au chapitre Ier du titre II du livre Ier de la deuxième partie du code des transports relevant de son article 5, paragraphe 3 sont soumis aux dispositions des titres Ier et II, à l’exception des articles L. 3113-1 à L. 3113-3, du second alinéa de l’article L. 3114-1 et des articles L. 3114-2, L. 3114-3 et L. 3114-7 à L. 3114-10.
