Article L3132-5 of the French Public procurement code

At the end of the works concession contract or the contract granting a public service concession, the assets referred to in article L. 3132-4 that have been depreciated during the performance of the concession contract are returned to the assets of the public entity free of charge, subject to the stipulations of the contract allowing the public entity to have the concessionaire take back any assets that are no longer required for the operation of the public service.
The granting to the concessionaire, for the duration of the contract, of ownership of the assets required for the public service other than the works established on the property of a public entity or certain real rights over these assets may not prevent the return of these assets free of charge to the assets of the public entity, subject to the stipulations allowing the public entity to have the assets that are no longer required for the operation of the public service taken back by the concessionaire.

Article L3132-5

Au terme du contrat de concession de travaux ou du contrat concédant un service public, les biens de retour mentionnés à l’article L. 3132-4 qui ont été amortis au cours de l’exécution du contrat de concession font retour dans le patrimoine de la personne publique gratuitement, sous réserve des stipulations du contrat permettant à celle-ci de faire reprendre par le concessionnaire les biens qui ne seraient plus nécessaires au fonctionnement du service public.
L’octroi au concessionnaire, pour la durée du contrat, de la propriété des biens nécessaires au service public autres que les ouvrages établis sur la propriété d’une personne publique ou certains droits réels sur ces biens ne peut faire obstacle au retour gratuit de ces biens dans le patrimoine de la personne publique, sous réserve des stipulations permettant à celle-ci de faire reprendre par le concessionnaire les biens qui ne seraient plus nécessaires au fonctionnement du service public.
