Article L3142-114 of the French Labour Code

The employer may postpone an employee’s departure on leave if such departure would result in the number of employees simultaneously absent or the number of days absent on such leave and on sabbatical leave being excessive in relation, respectively, to the total number of employees and the number of days worked in the company.

L’employeur peut différer le départ en congé du salarié lorsque ce départ aurait pour effet de porter l’effectif des salariés simultanément absents ou le nombre de jours d’absence au titre de ce congé et au titre du congé sabbatique à un niveau excessif au regard, respectivement, de l’effectif total et du nombre de jours travaillés dans l’entreprise.
