Article L3142-19 of the French Labour Code

The leave starts or is renewed at the employee’s initiative.

It may not exceed one year for the entire career, including renewals.

In the event of a sudden deterioration in the state of health of the person being cared for, a crisis situation requiring urgent action on the part of the family carer or the sudden cessation of accommodation in an establishment from which the person being cared for was benefiting, the leave starts or may be renewed without delay.

The employee may terminate the leave early or waive it in the following cases:

1° Death of the person being assisted ;

2° Admission to an institution of the person being cared for;

3° Significant reduction in the employee’s resources;

4° Use of a home help service to assist the person being helped;

5° Caregiver leave taken by another family member.

Le congé débute ou est renouvelé à l’initiative du salarié.

Il ne peut excéder, renouvellement compris, la durée d’un an pour l’ensemble de la carrière.

En cas de dégradation soudaine de l’état de santé de la personne aidée, de situation de crise nécessitant une action urgente du proche aidant ou de cessation brutale de l’hébergement en établissement dont bénéficiait la personne aidée, le congé débute ou peut être renouvelé sans délai.

Le salarié peut mettre fin de façon anticipée au congé ou y renoncer dans les cas suivants :

1° Décès de la personne aidée ;

2° Admission dans un établissement de la personne aidée ;

3° Diminution importante des ressources du salarié ;

4° Recours à un service d’aide à domicile pour assister la personne aidée ;

5° Congé de proche aidant pris par un autre membre de la famille.
