Article L3142-27 of the French Labour Code

In the absence of an agreement referred to in Article L. 3142-26, the following provisions apply:

1° The maximum duration of the leave is three months, renewable within the limit mentioned in article L. 3142-19;

2° The time limits for informing the employer by the employee of the taking of the leave and its renewal, the length of the notice period in the event of the employee returning before the planned end of the leave, as well as the time limits for the employee’s request and the employer’s response regarding the splitting of the leave or its conversion into a period of part-time work are set by decree.

A défaut de convention ou d’accord mentionné à l’article L. 3142-26, les dispositions suivantes sont applicables :

1° La durée maximale du congé est de trois mois, renouvelable dans la limite mentionnée à l’article L. 3142-19 ;

2° Les délais d’information de l’employeur par le salarié sur la prise du congé et son renouvellement, la durée du préavis en cas de retour du salarié avant le terme prévu du congé, ainsi que les délais de demande du salarié et de réponse de l’employeur sur le fractionnement du congé ou sa transformation en période d’activité à temps partiel sont fixés par décret.
