Article L3142-74 of the French Labour Code

In the absence of an agreement mentioned in article L. 3142-73, the following provisions apply:

1° The maximum duration of leave is six months. It is six weeks in the event of an emergency;

2° The length of service in the company required to qualify for leave is twelve months, consecutive or otherwise;

3° The rules according to which, depending on the size of the establishment, the maximum number of employees likely to benefit simultaneously from the leave and the deadlines mentioned in 4° of article L. 3142-73 within which the employee must send his request for leave to his employer are determined by decree.

A défaut de convention ou d’accord mentionné à l’article L. 3142-73, les dispositions suivantes sont applicables :

1° La durée maximale du congé est de six mois. Elle est de six semaines en cas d’urgence ;

2° L’ancienneté requise dans l’entreprise pour ouvrir droit au congé est de douze mois, consécutifs ou non ;

3° Les règles selon lesquelles sont déterminés, en fonction de l’effectif de l’établissement, le nombre maximal de salariés susceptibles de bénéficier simultanément du congé et les délais mentionnés au 4° de l’article L. 3142-73 dans lesquels le salarié adresse sa demande de congé à son employeur sont fixées par décret.
