Article L3142-92 of the French Labour Code

The employer may not terminate an employee’s employment contract due to absences resulting from an activity carried out as part of a commitment to serve in the operational reserve or following a call-up or recall of persons subject to the availability obligation.

At the end of a period performed under the first paragraph, the employee returns to his previous job.

L’employeur ne peut rompre le contrat de travail d’un salarié en raison des absences résultant d’une activité exercée au titre d’un engagement à servir dans la réserve opérationnelle ou faisant suite à un appel ou un rappel des personnes soumises à l’obligation de disponibilité.

A l’issue d’une période exécutée au titre du premier alinéa, le salarié retrouve son précédent emploi.
