Young workers may not be employed to work more than eight hours a day and thirty-five hours a week.
By way of derogation from the first paragraph, for certain activities determined by decree of the Conseil d’Etat, where the collective organisation of work justifies it, the following derogations may be made:
1° From the weekly working time of thirty-five hours, up to a maximum of five hours a week;
2° From the daily working time of eight hours, up to a maximum of two hours a day.
When the excesses provided for in 1° and 2° are applied:
a) Rest periods of a duration at least equivalent to the number of hours worked in excess of the daily working time of eight hours are allocated;
b) Any overtime, as well as any additional overtime, gives rise to an equivalent compensatory rest period.
For other activities and by way of exception, derogations to the maximum weekly and daily working hours set out in the first paragraph may be granted up to a maximum of five hours per week by the labour inspector after receiving the opinion of the occupational physician or the physician responsible for the medical monitoring of the student.
Under no circumstances may the working hours of the persons concerned exceed the normal daily or weekly working hours of adults employed in the establishment.
