Article L3211-5 of the French Public procurement code

The percentage of activity referred to in this section shall be determined by taking into account the average total turnover or any other appropriate activity-based parameter, such as costs incurred, over the three accounting periods preceding the award of the concession contract.
Where these elements are not available or are no longer relevant, the percentage of activity shall be determined on the basis of a realistic estimate.

Le pourcentage d’activités mentionné à la présente section est déterminé en prenant en compte le chiffre d’affaires total moyen ou tout autre paramètre approprié fondé sur les activités, tel que les coûts supportés, au cours des trois exercices comptables précédant l’attribution du contrat de concession.
Lorsque ces éléments ne sont pas disponibles ou ne sont plus pertinents, le pourcentage d’activités est déterminé sur la base d’une estimation réaliste.
