Article L3253-12 of the French Labour Code

The claims referred to in articles L. 3253-10 and L. 3253-11 are guaranteed:

1° When they are due and payable on the date of the judgment opening the proceedings ;

2° When, if a plan organising the safeguarding or legal recovery of the company is implemented at the end of the proceedings, they become due and payable as a result of the termination of the employment contract, within the time limits provided for in 2° of article L. 3253-8;

3° When there is a court-ordered liquidation or a court-ordered plan for the total sale of the company.

Article L3253-12

Les créances mentionnées aux articles L. 3253-10 et L. 3253-11 sont garanties :

1° Lorsqu’elles sont exigibles à la date du jugement d’ouverture de la procédure ;

2° Lorsque, si un plan organisant la sauvegarde ou le redressement judiciaire de l’entreprise intervient à l’issue de la procédure, elles deviennent exigibles du fait de la rupture du contrat de travail, dans les délais prévus au 2° de l’article L. 3253-8 ;

3° Lorsque intervient un jugement de liquidation judiciaire ou un jugement arrêtant le plan de cession totale de l’entreprise.
