Article L3253-2 of the French Labour Code

When safeguard, reorganisation or compulsory liquidation proceedings are initiated, remuneration of any kind due to employees for the last sixty days worked, less any advance payments already received, is paid, notwithstanding the existence of any other preferential claim, up to a monthly ceiling which is identical for all categories of beneficiaries.

This ceiling is set by regulation but may not be less than twice the ceiling used to calculate social security contributions.

Lorsqu’une procédure de sauvegarde, de redressement ou de liquidation judiciaire est ouverte, les rémunérations de toute nature dues aux salariés pour les soixante derniers jours de travail sont, déduction faite des acomptes déjà perçus, payées, nonobstant l’existence de toute autre créance privilégiée, jusqu’à concurrence d’un plafond mensuel identique pour toutes les catégories de bénéficiaires.

Ce plafond est fixé par voie réglementaire sans pouvoir être inférieur à deux fois le plafond retenu pour le calcul des cotisations de sécurité sociale.
