II – When a matter is referred to it by the competent authority of another Member State of the European Union, the college of supervisors shall send it a reasoned reply within three months.
It may ask the competent authority for information on a collective management organisation or an independent management organisation established in another Member State operating in France and, where appropriate, refer to it facts likely to constitute a breach by that organisation of the rules of that State relating to collective management organisations or independent management organisations.
III – Referrals that are manifestly abusive, in particular due to their number, repetitive or systematic nature, may be rejected without investigation or report by the chairman of the supervisory board.
IV -If sanction proceedings are initiated, the Control Board will notify the body concerned of the objections and will forward this notification and its investigation report to the Sanction Board. However, the Enforcement Board may not be seized of facts that date back more than three years if no action has been taken during that period to investigate, establish or punish them.
It may also apply to the competent court for the annulment of provisions of the Articles of Association, the General Regulations or a decision of the corporate bodies that do not comply with the regulations.
