Article L3322-6 of the French Labour Code

Participation agreements are concluded in one of the following ways:

1° By collective labour agreement ;

2° By agreement between the employer and the representatives of representative trade union organisations in the company;

3° By agreement reached within the social and economic committee;

4° Following ratification, by a two-thirds majority of the workforce, of a draft contract proposed by the employer. If there are one or more representative trade union organisations or a social and economic committee in the company, ratification is requested jointly by the employer and one or more of these organisations or this committee.

Les accords de participation sont conclus selon l’une des modalités suivantes :

1° Par convention ou accord collectif de travail ;

2° Par accord entre l’employeur et les représentants d’organisations syndicales représentatives dans l’entreprise ;

3° Par accord conclu au sein du comité social et économique ;

4° A la suite de la ratification, à la majorité des deux tiers du personnel, d’un projet de contrat proposé par l’employeur. S’il existe dans l’entreprise une ou plusieurs organisations syndicales représentatives ou un comité social et économique, la ratification est demandée conjointement par l’employeur et une ou plusieurs de ces organisations ou ce comité.
