Article L3322-9 of the French Labour Code

Any company may apply a participation scheme concluded at branch level, provided that the branch agreement has been approved pursuant to article L. 3345-4.

Undertakings wishing to apply the approved branch agreement shall conclude an agreement to this effect under the conditions provided for in Article L. 3322-6.

Undertakings with fewer than fifty employees may opt to apply this scheme by means of a unilateral document signed by the employer, under the conditions provided for in Article L. 2232-10-1, if the branch agreement provides for this possibility and proposes, in the form of a standard agreement indicating the various choices left to the employer, specific stipulations for these undertakings.

The company agreement concluded or the unilateral adherence document signed is filed in accordance with the procedures laid down in article L. 3323-4.

Notwithstanding articles L. 3345-2 and L. 3345-3, the exemptions provided for in Chapter V of this Title are deemed to have been acquired as soon as the agreement or the document of adherence to the approved branch agreement is filed and for the duration of its application.

Toute entreprise peut faire application d’un dispositif de participation conclu au niveau de la branche, dès lors que l’accord de branche a été agréé en application de l’article L. 3345-4.

Les entreprises qui souhaitent appliquer l’accord de branche agréé concluent à cet effet un accord dans les conditions prévues à l’article L. 3322-6.

Les entreprises de moins de cinquante salariés peuvent opter pour l’application de ce régime au moyen d’un document unilatéral d’adhésion de l’employeur, dans les conditions prévues à l’article L. 2232-10-1, si l’accord de branche prévoit cette possibilité et propose, sous forme d’accord type indiquant les différents choix laissés à l’employeur, des stipulations spécifiques pour ces entreprises.

L’accord d’entreprise conclu ou le document unilatéral d’adhésion signé est déposé selon les modalités prévues à l’article L. 3323-4.

Par dérogation aux articles L. 3345-2 et L. 3345-3, les exonérations prévues au chapitre V du présent titre sont réputées acquises dès le dépôt et pour la durée d’application de l’accord ou du document d’adhésion à l’accord de branche agréé.
