Article L3331-2 of the French Public Health Code

In order to sell alcoholic beverages, restaurants that do not hold an on-trade licence must hold one of the following two categories of licence:

1° The “small restaurant licence”, which allows drinks from the third group to be sold for consumption on the premises, but only during the main meal and as an accessory to the food;

2° The “restaurant licence” itself, which allows all drinks authorised for consumption on the premises to be sold, but only during main meals and as an accessory to food.

The establishments in question are not subject to the prohibitions mentioned in articles L. 3332-1 and L. 3332-2, or to the regulations established pursuant to articles L. 3335-1, L. 3335-2 and L. 3335-8.

Article L3331-2

Les restaurants qui ne sont pas titulaires d’une licence de débit de boissons à consommer sur place doivent, pour vendre des boissons alcooliques, être pourvus de l’une des deux catégories de licence ci-après :

1° La ” petite licence restaurant ” qui permet de vendre les boissons du troisième groupe pour les consommer sur place, mais seulement à l’occasion des principaux repas et comme accessoires de la nourriture ;

2° La ” licence restaurant ” proprement dite qui permet de vendre pour consommer sur place toutes les boissons dont la consommation est autorisée, mais seulement à l’occasion des principaux repas et comme accessoires de la nourriture.

Les établissements dont il s’agit ne sont soumis ni aux interdictions mentionnées aux articles L. 3332-1 et L. 3332-2, ni à la réglementation établie en application des articles L. 3335-1, L. 3335-2 et L. 3335-8.
