Article L3331-3 of the French Public Health Code

Establishments holding an on-licence or a restaurant licence may sell to take away the drinks corresponding to the category of their licence.

In order to sell alcoholic beverages, other takeaway outlets must hold one of the following two categories of licence:

1° The “small takeaway licence” includes authorisation to sell drinks from the third group;

2° The “takeaway licence” itself includes authorisation to sell for takeaway all drinks the sale of which is authorised.

Les établissements titulaires d’une licence à consommer sur place ou d’une licence de restaurant peuvent vendre pour emporter les boissons correspondant à la catégorie de leur licence.

Les autres débits de boissons à emporter doivent, pour vendre des boissons alcooliques, être pourvus de l’une des deux catégories de licences ci-après :

1° La ” petite licence à emporter ” comporte l’autorisation de vendre pour emporter les boissons du troisième groupe ;

2° La ” licence à emporter ” proprement dite comporte l’autorisation de vendre pour emporter toutes les boissons dont la vente est autorisée.
