Article L3333-3 of the French Labour Code

The agreement sets the rules for the inter-company savings plan.

These rules determine in particular:

1° The signatory companies or the professional and geographical scope ;

2° The nature of the sums that may be paid in;

3° The various possibilities for allocating the sums collected, in particular the number, management orientation and risk profile of the funds used;

4° The conditions under which account management fees are paid by employers;

5° The list of different contribution rates and ceilings from which companies wishing to make additional payments to those made by their employees may choose;

6° The conditions under which the members of the supervisory boards of the mutual funds provided for in the plan regulations are appointed and the operating procedures of the boards.

L’accord fixe le règlement du plan d’épargne interentreprises.

Ce règlement détermine notamment :

1° Les entreprises signataires ou le champ d’application professionnel et géographique ;

2° La nature des sommes qui peuvent être versées ;

3° Les différentes possibilités d’affectation des sommes recueillies, en particulier le nombre, l’orientation de gestion et le profil de risque des fonds utilisés ;

4° Les conditions dans lesquelles les frais de tenue de compte sont pris en charge par les employeurs ;

5° La liste de différents taux et plafonds d’abondement parmi lesquels les entreprises souhaitant effectuer des versements complémentaires à ceux de leurs salariés pourront opter ;

6° Les conditions dans lesquelles sont désignés les membres des conseils de surveillance des fonds communs de placement prévus par le règlement du plan et les modalités de fonctionnement des conseils.
