The sale of alcoholic beverages to minors is punishable by a fine of €7,500. The offer of these drinks free of charge to minors, in public houses and all shops or public places, or the offer, free of charge or for consideration, to a minor of any object directly encouraging excessive consumption of alcohol under the conditions set out in article L. 3342-1 is punishable by the same penalty.
Conviction of one of the offences provided for in this article after less than five years’ imprisonment for an offence provided for in this chapter doubles the maximum penalty.
Natural persons guilty of one of the offences mentioned in the first paragraph are also liable to the additional penalty of a temporary ban on exercising the rights attached to a drinks outlet licence for consumption on the premises or to take away for a period of up to one year.
Legal entities guilty of one of the offences referred to in the first paragraph are liable to the additional penalties provided for in 2°, 4°, 8° and 9° of article 131-39 of the Criminal Code.
For the offence referred to in the first paragraph of this article, even in the event of a repeat offence, the public prosecution may be extinguished, under the conditions set out in articles 495-17 to 495-25 of the Code of Criminal Procedure, by the payment of a fixed fine of €300. The amount of the reduced fixed fine is €250 and the amount of the increased fixed fine is €600.
