Article L341-10 of the French Tourism Code

Breaches of the mooring regulations are recorded by officers and agents of the judicial police and by State officials and agents authorised to record breaches of the seaport regulations, the navigation regulations and the regulations governing the conservation of the public maritime and river domain. Where the beneficiary of the authorisation is a local authority, they may also be recorded by civil servants and agents of these authorities, sworn in and commissioned for this purpose by the president of the regional council, the president of the departmental council or the mayor, as appropriate.

Les infractions à la police du mouillage sont constatées par les officiers et agents de police judiciaire et par les fonctionnaires et agents de l’Etat habilités à constater les infractions à la police des ports maritimes, à la police de la navigation et à la police de la conservation du domaine public maritime et fluvial. Elles peuvent également, lorsque le bénéficiaire de l’autorisation est une collectivité territoriale, être constatées par des fonctionnaires et agents de ces collectivités, assermentés et commissionnés à cet effet par le président du conseil régional, le président du conseil départemental ou le maire, selon le cas.
