TITLE IV: DEVELOPMENT AND REGULATION OF TOURIST AREAS.

Article L. 5314-4 of the French Transport Code sets out the rules governing the powers of communes, communities of communes, urban communities, metropolises and conurbation communities to create, develop and operate seaports whose main activity is yachting.

The rules relating to the obligations imposed by the concession-granting authority of a marina, concerning the reconstitution of artificial beach areas, are set out in Article L. 321-4 of the Environment Code hereafter reproduced: “Art. Before being connected to the sea or to existing harbour basins, basins and water areas intended to accommodate pleasure craft must be incorporated into the public domain, with a quayside strip, connected to the public highway, of sufficient width for the circulation and operation of the installations.

Article L. 2124-5 of the General Code for the Ownership of Public Property sets out the rules for authorisations for temporary occupation of the public domain, which may be granted for the development, organisation and management of anchorage areas and light facilities.

The beneficiary of such an authorisation may be entitled to charge users a fee for services rendered.

Breaches of the mooring regulations are recorded by officers and agents of the judicial police and by State officials and agents authorised to record breaches of the seaport regulations, the navigation regulations and the regulations governing the conservation of the public maritime and river domain.
