Article L342-4 of the French Tourism Code

Where the implementation of the development project requires the conclusion of several contracts, the relations between the municipality, group of municipalities or public-private partnership and the various operators are organised by a prior memorandum of understanding, which may set out the general timetable for the project, determine the purpose of the various individual contracts and lay down the general conditions for the construction, management and transfer between the parties of public facilities and services, as well as the principles governing the financial obligations between the parties. The individual contracts concluded for each purpose comply with the provisions of the memorandum of understanding.

Lorsque la mise en oeuvre de l’opération d’aménagement suppose la conclusion de plusieurs contrats, les relations de la commune, du groupement de communes ou du syndicat mixte et des différents opérateurs sont organisées par un protocole d’accord préalable qui peut prévoir l’échéancier général de l’opération, déterminer l’objet des différents contrats particuliers et fixer les conditions générales de réalisation, de gestion et de transfert entre les parties des équipements collectifs et des services publics ainsi que les principes régissant les obligations financières entre les parties. Les contrats particuliers conclus pour chaque objet respectent les dispositions du protocole d’accord.
