Article L342-1 of the French Tourism Code

In mountain areas, tourism development operations are carried out under the control of a municipality, a group of municipalities or a mixed syndicate of local authorities. Unless it is done on a “régie” basis, implementation is carried out under the following conditions:

1° Each operator must enter into a contract with the commune or grouping of communes or the competent mixed syndicate;

2° Each of the contracts relates to one or more of the constituent parts of the tourism operation: studies, land and property development, construction and management of public facilities, construction and operation of the ski lift network, management of public services, events and promotion.

Article L342-1

En zone de montagne, la mise en oeuvre des opérations d’aménagement touristique s’effectue sous le contrôle d’une commune, d’un groupement de communes ou d’un syndicat mixte regroupant des collectivités territoriales. Sauf recours à la formule de la régie, cette mise en oeuvre s’effectue dans les conditions suivantes :

1° Chaque opérateur doit contracter avec la commune ou le groupement de communes ou le syndicat mixte compétent ;

2° Chacun des contrats porte sur l’un ou plusieurs des objets constitutifs de l’opération touristique : études, aménagement foncier et immobilier, réalisation et gestion des équipements collectifs, construction et exploitation du réseau de remontées mécaniques, gestion des services publics, animation et promotion.
