I. – The design, construction and modification of ski lifts, the way in which they are operated and the checks carried out to ensure that they are in good working order are subject to administrative and technical safety rules and to the supervision of officials from the Ministry of Transport.
II. – For the construction and substantial modification of a ski lift, the project owner entrusts the project management to a project manager who holds an authorisation issued on the basis of recognised competence criteria in the ski lift sector. The work entrusted to the project manager may not include execution studies or the execution of the works.
III. – Checks on the working order of the installations and their maintenance are carried out by persons approved on the basis of recognised competence criteria in the ski lift sector.
The competent State authority may make the continued operation of a ski lift conditional upon a diagnosis, compliance with restrictive operating measures, the addition of safety systems or the replacement of defective components.
IV. – If the rules laid down for operation are not complied with or if there is a risk to safety, the competent State authority, after hearing the operator, gives him formal notice to take the necessary measures to ensure that the installation is made safe. On expiry of the period set for the implementation of the safety requirements, the competent State authority may order the suspension of operation until these requirements have been met.
In the event of an emergency and in order to ensure the immediate safety of people, the shutdown of operations may be ordered.
V. – The conditions for applying this article, in particular the conditions for issuing the approvals provided for in II and III, are laid down by decree in the Conseil d’Etat.
