Private property or property forming part of the private domain of a public authority may be encumbered, for the benefit of the commune, group of communes, département or mixed syndicate concerned, by an easement intended to ensure the passage, development and equipment of downhill ski runs and Nordic sites intended for organised non-motorised snow sports, the overflight of land where ski lifts are to be installed, the installation of line supports with a footprint of less than four square metres, the passage of uphill slopes, the access necessary for the installation, maintenance and protection of ski runs and ski lift installations.
After consulting the Chamber of Agriculture, an easement may be instituted to ensure, within the perimeter of a Nordic site or a ski area, the passage, development and equipment of non-motorised leisure trails outside snow cover periods. This opinion is deemed favourable if it is not given within two months of the request for the easement being sent.
Where the geographical situation so requires, an easement may be instituted to ensure access to mountaineering sites, climbing sites in mountain areas and nature sports sites, within the meaning of article L. 311-1 of the French Sports Code, as well as access to mountain refuges.
