Article L3512-27 of the French Public Health Code

For the application of sections 1 to 5 of this chapter, in the collectivities governed by Article 73 of the Constitution, in Saint-Martin, in Saint-Barthélemy and in Saint-Pierre-et-Miquelon:

1° The words: “tobacco shop” are replaced by the words: “place of sale of tobacco, tobacco products or ingredients defined in Article L. 3512-2”;

2° Article L. 3512-4 is amended as follows:

a) In the local authorities governed by Article 73 of the Constitution and in Saint-Martin and Saint-Barthélemy, the words: “sale of a tobacco product at a price lower than that approved in accordance with Article 572 of the General Tax Code” are replaced by the words: “sale of a product below the price defined in Article L. 3512-28”;

b) In Saint-Pierre-et-Miquelon, the words “or sale of a tobacco product at a price lower than that approved in accordance with Article 572 of the General Tax Code” do not apply;

c) The second paragraph does not apply;

d) In Saint-Pierre-et-Miquelon and Saint-Barthélemy, 2° does not apply.

Article L3512-27

Pour l’application des sections 1 à 5 du présent chapitre, dans les collectivités régies par l’article 73 de la Constitution, à Saint-Martin, à Saint-Barthélemy et à Saint-Pierre-et-Miquelon :

1° Les mots : “ débit de tabac ” sont remplacés par les mots : “ lieu de vente du tabac, de produits du tabac ou des ingrédients définis à l’article L. 3512-2 ” ;

2° L’article L. 3512-4 est ainsi modifié :

a) Dans les collectivités régies par l’article 73 de la Constitution et à Saint-Martin et à Saint-Barthélemy, les mots : “ vente d’un produit de tabac à un prix inférieur à celui qui a été homologué conformément à l’article 572 du code général des impôts ” sont remplacés par les mots : “ vente d’un produit en dessous du prix défini à l’article L. 3512-28 ” ;

b) A Saint-Pierre-et-Miquelon, les mots : “ ou vente d’un produit du tabac à un prix inférieur à celui qui a été homologué conformément à l’article 572 du code général des impôts ” ne sont pas applicables ;

c) Le deuxième alinéa n’est pas applicable ;

d) A Saint-Pierre-et-Miquelon et à Saint-Barthélemy, le 2° n’est pas applicable.
