Article L3641-7 of the French General Code of Local Authorities

The State may transfer to the Metropole of Lyon, at its request, the ownership, development, maintenance and management of major facilities and infrastructures, if applicable located outside its perimeter, after receiving the opinion of the territorially competent departmental council. These transfers are carried out free of charge and do not give rise to the payment of any compensation or tax or any duty, salary or fee.

The transfer is authorised by decree. An agreement concluded between the State and the beneficiary metropolis specifies the terms and conditions of the transfer.

L’Etat peut transférer à la métropole de Lyon, sur sa demande, la propriété, l’aménagement, l’entretien et la gestion de grands équipements et infrastructures, le cas échéant situés en dehors de son périmètre, après avis du conseil départemental territorialement compétent. Ces transferts sont réalisés à titre gratuit et ne donnent lieu au paiement d’aucune indemnité ou taxe ni d’aucuns droit, salaire ou honoraires.

Le transfert est autorisé par décret. Une convention conclue entre l’Etat et la métropole bénéficiaire précise les modalités du transfert.
