Article L365-1 of the French Insurance Code

Any insurance undertaking whose registered office is located in the territory of a Member State of the European Union, which participates in the cover of a large risk as defined in Article L. 111-6 located in France, within the framework of a co-insurance transaction carried out under the freedom to provide services, where at least one of the participants is not established in the same Member State of the European Union as the lead insurer, is exempt, if it is not the lead insurer, from the obligations set out in Articles L. 362-2 and L. 421-15.

A Conseil d’Etat decree shall determine the terms and conditions for the application of this article.

Article L365-1

Toute entreprise d’assurance dont le siège social est situé sur le territoire d’un Etat membre de l’Union européenne, qui participe à la couverture d’un grand risque tel que défini à l’article L. 111-6 situé en France, dans le cadre d’une opération de coassurance réalisée en libre prestation de services dont l’un au moins des participants n’est pas établi dans le même Etat membre de l’Union européenne que l’apériteur, est dispensée, si elle n’est pas l’apériteur, des obligations prévues aux articles L. 362-2 et L. 421-15.

Un décret en Conseil d’Etat détermine les modalités d’application du présent article.
