Article L3824-5 of the French Public Health Code

I.-In the event that the medical transfer order has been issued on the basis of I of article L. 3824-1, the High Commissioner will, upon arrival in the territory of the host community, transfer the person concerned to an establishment authorised to treat people suffering from mental disorders and the procedure for admission to psychiatric care at the request of a third party or in the event of imminent danger will then be implemented in accordance with the regulations applicable locally.

II – In the event that the health transfer order has been issued on the basis of II of article L. 3824-1, the High Commissioner assesses whether it is appropriate to implement the procedure for admission to care by decision of the State representative in accordance with the regulations applicable locally.

I.-Dans le cas où l’arrêté de transfert sanitaire a été pris sur le fondement du I de l’article L. 3824-1, le haut-commissaire achemine l’intéressé, dès son arrivée sur le territoire de la collectivité d’accueil, vers un établissement habilité à soigner les personnes atteintes de troubles mentaux et la procédure d’admission en soins psychiatriques à la demande d’un tiers ou en cas de péril imminent est alors mise en œuvre selon la réglementation applicable localement.

II.-Dans le cas où l’arrêté de transfert sanitaire a été pris sur le fondement du II de l’article L. 3824-1, le haut-commissaire apprécie s’il y a lieu de mettre en œuvre la procédure d’admission en soins sur décision du représentant de l’Etat selon la réglementation applicable localement.
