Article L431-5 of the French Insurance Code

The State guarantee may be granted to the Caisse Centrale de Réassurance in respect of its reinsurance of risks covered by insurance or the financial guarantee pursuant to article L. 597-7 of the Environment Code.

The State guarantee referred to in the first paragraph of this article is subject to a ceiling of 700 million euros per nuclear facility, within the meaning of article L. 597-2 of the Environment Code, and per nuclear accident. In the event of the transport of nuclear substances, the amount of this guarantee is, for transport within the territory of the French Republic, €80 million per nuclear accident and, for international transport, the amount set by the State of dispatch, destination or transit of these substances, subject to a ceiling of €700 million per nuclear accident.

The State guarantee is remunerated and may not cover, for each reinsurance operation, more than 60% of the total risk covered by the insurance or financial guarantee in application of article L. 597-7 of the Environment Code. It is granted by order of the Minister for the Economy.

Article L431-5

La garantie de l’Etat peut être octroyée à la caisse centrale de réassurance au titre de ses opérations de réassurance des risques couverts par l’assurance ou la garantie financière en application de l’article L. 597-7 du code de l’environnement.

La garantie de l’Etat mentionnée au premier alinéa du présent article s’exerce dans la limite d’un plafond de 700 millions d’euros par installation nucléaire, au sens de l’article L. 597-2 du code de l’environnement, et par accident nucléaire. En cas de transport de substances nucléaires, le montant de cette garantie s’élève, pour un transport effectué sur le territoire de la République française, à 80 millions d’euros par accident nucléaire et, pour un transport international, au montant fixé par l’Etat d’expédition, de destination ou de transit de ces substances, dans la limite d’un plafond de 700 millions d’euros par accident nucléaire.

La garantie de l’Etat est rémunérée et ne peut couvrir, pour chaque opération de réassurance, plus de 60 % du risque total couvert par l’assurance ou la garantie financière en application de l’article L. 597-7 du code de l’environnement. Elle est octroyée par arrêté du ministre chargé de l’économie.
