By way of derogation from the provisions of article L. 4311-2, the practice of the profession of nurse is permitted either as a multi-purpose auxiliary, or for one or more establishments or for a specific type of activity:
1° Persons in possession of certificates, qualifications or attestations, the list of which and the conditions of validity of which are laid down by order of the Minister for Health.
However, certificates, titles or attestations issued in a State which is not a member of the European Union or a party to the Agreement on the European Economic Area may only allow the practice of the profession of nurse insofar as the French State diploma itself allows the practice of this profession in that State. This latter provision does not apply to persons with political refugee status or to persons legally practising the profession of nurse in France on 13 July 1980;
2° Students and apprentices preparing for the State diploma as part of their work placement or apprenticeship period, in health establishments and centres or medico-social establishments and services, outpatient care facilities and private practices approved for work placements. Students and apprentices may personally perform procedures in each place of training, under the responsibility of a qualified nurse.
For the purposes of reimbursement or reimbursement by the health insurance scheme, procedures performed in this way are deemed to have been performed by the qualified nurse;
3° Student officers and merchant navy officers for the duration of their health training course carried out in establishments or services approved by the Minister for Health.
The date and procedures for the termination of the derogation schemes mentioned in this article are set by decree.
