Article L4311-13 of the French Public Health Code

By way of derogation from the provisions of article L. 4311-2, operating and instrumental assistants who have been carrying out this professional activity on a voluntary or salaried basis for at least six years prior to 28 July 1999, and who have passed, before 31 December 2005, knowledge verification tests under conditions determined by decree of the Conseil d’Etat, may perform acts of assistance to a practitioner during surgery.

The knowledge verification test is intended exclusively to authorise the practice of the professional activities of operating assistants and instrument assistants.

Any employer of operating or instrument assistants is required to offer these staff a training plan integrated into working hours, leading to their retention within the establishment, under conditions and within timeframes defined by decree.

Par dérogation aux dispositions de l’article L. 4311-2, peuvent accomplir des actes d’assistance auprès d’un praticien au cours d’une intervention chirurgicale les personnels aides-opératoires et aides-instrumentistes exerçant cette activité professionnelle à titre bénévole ou salarié depuis une durée au moins égale à six ans avant le 28 juillet 1999, et ayant satisfait, avant le 31 décembre 2005, à des épreuves de vérification des connaissances dans des conditions déterminées par décret en Conseil d’Etat.

L’épreuve de vérification des connaissances est destinée à autoriser exclusivement l’exercice des activités professionnelles d’aides-opératoires et aides-instrumentistes.

Tout employeur de personnel aide-opératoire ou aide-instrumentiste est tenu de proposer à ces personnels un plan de formation intégré dans le temps de travail, aboutissant à son maintien au sein de l’établissement, dans des conditions et des délais définis par décret.
