Persons who obtained the evidence of formal qualifications or authorisation required to practise the profession of nurse before they entered the profession, and persons who did not practise the profession but obtained their evidence of formal qualifications less than three years ago, are required to register with the service or body designated for this purpose by the Minister for Health.
The registration of these persons is carried out after verification of the supporting documents attesting to their identity and their evidence of formal qualifications or authorisation. They must inform the same department or body of any change of residence or professional situation.
For people who have worked as nurses, the obligation to provide information about a change of residence is maintained for a period of three years from the date on which they ceased their activity.
The registration procedure is free of charge.
A list of this profession is drawn up for each département by the department or body designated for this purpose and made available to the public. This list shall mention, where applicable, the specialist or advanced practice titles held by the professionals.
Subject to the provisions of Article L. 4061-1, no person may practise the profession of nurse unless he or she has fulfilled the obligation set out in the first paragraph and is registered on the roll of nurses. However, a nurse who does not have a professional residence may be authorised by the departmental council of the order of nurses, for a limited period, renewable under the same conditions, to replace a nurse.
The Director General of the Regional Health Agency and the Public Prosecutor’s Office have permanent access to the register of the Departmental Council of Nurses and may obtain a copy of it. The list of professionals registered on this register is made available to the public under conditions laid down by decree.
The national order of nurses has a right of access to the nominative lists of nurses not covered by the provisions of article L. 4138-2 of the defence code employed by public and private structures and may obtain communication of these lists.
These nominative lists are used, in particular, to automatically register nurses on the roll kept by the Association, in accordance with conditions laid down by decree.
A nurse may be registered on only one departmental list. This registration does not limit the geographical scope of practice.
Detailed rules for the application of this article shall be laid down by decree.
