Article L434-10 of the French Code governing the entry and residence of foreign nationals and the right of asylum

Authorisation to enter France as part of the family reunification procedure is given by the competent administrative authority after verification of housing and income conditions by the mayor of the foreign national’s commune of residence or the mayor of the commune where he/she plans to settle.
The mayor, when approached by the administrative authority, may issue an opinion on the condition mentioned in 3° of article L. 434-7. This opinion is deemed to have been given on expiry of a period of two months from the date on which the administrative authority sends the file.

L’autorisation d’entrer en France dans le cadre de la procédure du regroupement familial est donnée par l’autorité administrative compétente après vérification des conditions de logement et de ressources par le maire de la commune de résidence de l’étranger ou le maire de la commune où il envisage de s’établir.
Le maire, saisi par l’autorité administrative, peut émettre un avis sur la condition mentionnée au 3° de l’article L. 434-7. Cet avis est réputé rendu à l’expiration d’un délai de deux mois à compter de la communication du dossier par l’autorité administrative.
