Undertakings subject to supervision by the Autorité de contrôle prudentiel et de résolution, other undertakings mentioned in article L. 310-2 or reinsurance undertakings, which use the services of intermediaries, must ensure that these intermediaries are registered in accordance with the provisions of article L. 512-1.
Undertakings which use the services of intermediaries who are nationals of a Member State of the European Union or of another State party to the Agreement on the European Economic Area other than France and who are operating on French territory under the freedom to provide services or the freedom of establishment must check with the body which keeps the register provided for in I of Article L. 512-1 that these intermediaries are registered in accordance with the law of their country of origin.
The body that keeps the register referred to in I of Article L. 512-1 shall refuse to register an intermediary if the laws, regulations or administrative provisions of a third country applicable to one or more natural or legal persons with which the intermediary has close links within the meaning of 9° of Article L. 310-3, or difficulties relating to the implementation of these laws, regulations and administrative provisions, prevent the intermediary from carrying out his duties properly.
