Article L512-29 of the French Consumer Code

Authorised officers may carry out seizures without judicial authorisation in the case of flagrante delicto falsification or when they concern:

1° Products found to be falsified, corrupted or toxic;

2° Products found to be unfit for consumption, with the exception of products of animal origin, foodstuffs containing them and animal feedstuffs of animal origin or containing products of animal origin whose unfit for consumption can only be recognised on the basis of abnormal organoleptic characteristics or signs of lesional pathology ;

3° Products, objects or appliances suitable for falsification in the cases provided for in Articles L. 413-1 and L. 413-2;

4° Goods, objects or appliances recognised as not complying with the laws and regulations in force and presenting a danger to the health or safety of consumers;

5° Goods presented under an infringing trademark, collective trademark or guarantee mark.

Article L512-29

Les agents habilités peuvent effectuer des saisies sans autorisation judiciaire dans le cas d’un flagrant délit de falsification ou lorsqu’elles portent sur :

1° Les produits reconnus falsifiés, corrompus ou toxiques ;

2° Les produits reconnus impropres à la consommation, à l’exception des produits d’origine animale, des denrées alimentaires en contenant ainsi que des aliments pour animaux d’origine animale ou contenant des produits d’origine animale dont l’impropriété à la consommation ne peut être reconnue qu’en fonction de caractères organoleptiques anormaux ou de signes de pathologie lésionnelle ;

3° Les produits, objets ou appareils propres à effectuer des falsifications dans les cas prévus aux articles L. 413-1 et L. 413-2 ;

4° Les produits, objets ou appareils reconnus non conformes aux lois et règlements en vigueur et présentant un danger pour la santé ou la sécurité des consommateurs ;

5° Les produits présentés sous une marque, une marque collective ou une marque de garantie contrefaisantes.
