Article L512-41 of the French Consumer Code

The public prosecutor, if he considers, in the light of the reports drawn up by the authorised agents or the test or analysis report and, if necessary, after a preliminary investigation, that proceedings should be instituted or an investigation opened, refers the matter to the court or the investigating judge, as appropriate.
If an expert opinion is required, it shall be ordered and carried out in accordance with the provisions and in the form set out in Articles 156 to 169 of the Code of Criminal Procedure, subject to the reservations mentioned in the articles of this sub-section.

Le procureur de la République, s’il estime, au vu des procès-verbaux dressés par les agents habilités ou du rapport d’essais ou d’analyses et, au besoin, après enquête préalable, que des poursuites doivent être engagées ou une information ouverte, saisit, suivant le cas, le tribunal ou le juge d’instruction.
S’il y a lieu à expertise, celle-ci est ordonnée et exécutée selon les prescriptions et dans les formes prévues aux articles 156 à 169 du code de procédure pénale, sous les réserves mentionnées aux articles de la présente sous-section.
