Article L512-8 of the French Monetary and Financial Code

When, after repayment of the company’s debts, including advances of any kind granted by the federal bank, liquidation costs and the paid-up portion of the shares, the dissolution or liquidation of a banques populaires shows a surplus of assets, the amount of this surplus is paid into the collective guarantee fund instituted by article L. 512-16. However, the central body of the caisses d’épargne et des banques populaires may allocate it, in whole or in part, to another purpose in accordance with the interests of the banques populaires.

Article L512-8

Lorsque, après remboursement des dettes sociales, y compris les avances de toute nature consenties par la banque fédérale, des frais de liquidation et de la fraction libérée des parts sociales, la dissolution ou la liquidation d’une banque populaire fait apparaître un excédent d’actif, le montant de cet excédent est versé au fonds collectif de garantie institué par l’article L. 512-16. Toutefois, l’organe central des caisses d’épargne et des banques populaires peut lui donner pour tout ou partie une autre affectation conforme aux intérêts des banques populaires.
