Article L5125-13 of the French Public Health Code

An assistant pharmacist working exclusively in a pharmacy operated by a société d’exercice libéral may hold, directly or through a société de participations financières de profession libérale that he controls, a fraction of the capital of this société d’exercice libéral representing up to 10% of the latter.

The associate pharmacist associated with the private limited company operating the pharmacy in which he works continues to work under an employment contract and remains legally subordinate to the pharmacist(s) in charge of the pharmacy.

The terms and conditions for the application of this article are defined by decree in the Conseil d’Etat, issued after consultation with the Conseil national de l’ordre des pharmaciens and the most representative organisations in the profession.

Le pharmacien adjoint exerçant à titre exclusif son activité dans une officine exploitée par une société d’exercice libéral peut détenir, directement ou par l’intermédiaire d’une société de participations financières de profession libérale qu’il contrôle, une fraction du capital de cette société d’exercice libéral représentant jusqu’à 10 % de celui-ci.

Le pharmacien adjoint associé de la société d’exercice libéral exploitant l’officine dans laquelle il exerce continue d’exercer dans le cadre d’un contrat de travail et demeure placé dans un lien de subordination juridique à l’égard du ou des pharmaciens titulaires de l’officine.

Les modalités et les conditions d’application du présent article sont définies par décret en Conseil d’Etat, pris après avis du Conseil national de l’ordre des pharmaciens et des organisations les plus représentatives de la profession.
