A pharmacy may only remain open in the absence of its proprietor if the latter has been duly replaced. The annex mentioned in article L. 5125-7-1 may not remain open to the public in the absence of a pharmacist.
The legal duration of a replacement may not, under any circumstances, exceed one year. However, in the event of national service or being called up for military service, this period is extended until such time as the impediment ceases.
By way of derogation from the second paragraph, this period of one year may be renewed once by decision of the Director General of the Regional Health Agency when the absence of the pharmacist is justified by his state of health.
After the death of a pharmacist, the period during which his spouse or heirs may keep a pharmacy open by having it managed by a pharmacist authorised for this purpose by the general manager of the regional health agency to replace the deceased pharmacist may not exceed two years. This period may be extended, for a period not exceeding one year, by the general director of the regional health agency in the event of an exceptional situation. At the end of this period, the Director General of the Regional Health Agency may apply Article L. 5125-22.
